Cohn & Roth was formed in 1985 by Michael H. Cohn and William M. Roth practicing in the areas of foreclosure, bankruptcy, related title work, eviction and REO closings. Our practice covers the entire State of New York, including State trial and appellate level courts, Federal District Courts and Bankruptcy Courts.
The firm handles foreclosure work for a number of banks and mortgage servicers located throughout the United States which own or service mortgage loans relating to property located in New York State. Many of these actions involve loans insured or owned by Fannie Mae, Freddie Mac, FHA, VA, etc. Our firm also handles considerable volume of work for servicers whose portfolios are primarily made up of B & C or other loans and we are familiar with the special needs of these types of lenders and servicers.
Michael H. Cohn, is a graduate of New York University and a cum laude graduate of the Syracuse University College of Law. Mr. Cohn was admitted to practice in New York in 1977. He began practice as a trial attorney with the United States Department of Justice, Washington, D.C. in the Commercial Litigation Branch of the Civil Division handling cases for among others, HUD, GinnieMae, FHA and FannieMae. After several years, he went into private practice with a large New York City firm and some years later, opened his own practice. Mr. Cohn is a member of the New York Bar and admitted to practice in all of the United States District Courts of New York
William M. Roth, a graduate of Pace College of Law where his studies focused on real property, bankruptcy and creditors rights. He was admitted to practice in New York State in 1985 and is also admitted to the US District Courts of the Southern, Eastern, Northern and Western Districts. Mr Roth's practice currently focuses on mortgage foreclosure, bankruptcy and eviction in Supreme, Civil and Bankruptcy courts . Mr Roth is a member of the New York State Bar and an active member of the New York City real estate community where he has functioned as Board President, Member and advisor to several Coop and Condominium Associations.
Michael Nayar is an associate attorney with the firm. His practice spans a wide range of foreclosure litigation, including, financial institutions in routine foreclosure litigation to more complex actions related to lending practices, loan origination, debt collection practices, loan servicing, and deceptive business practices. His practice also includes the defense of claims arising under the Truth in Lending Act, Real Estate Settlement Procedures Act, Fair Credit Reporting Act, and Fair Debt Collection Practices Act, as well as a variety of state and common law claims. He also has experience in transactional real estate matters.
Edward Klein an associate of the firm graduated cum laude from the State University of New York at Albany in 1980 and recieved his law degree from Boston University in 1983. He has also completed post doctoral classes at the Touro College Jacob D. Fuchsburg Law Center. Mr. Klein is a member of the New York Bar, and is admitted to the United States District Courts for the Southern, Eastern and Western Districts of New York. He is a member of the New York Bar Association. Mr. Klein's practice has concentrated in the areas of residential mortgage foreclosure, bankruptcy, creditor's rights and consumer debt for over twenty years.
Kevin MacTiernan, an associate of the firm holds a B.A. in Political Science from Hofstra University and earned his Juris Doctor from the New York Law School in 2014. Mr. MacTiernan is admitted to the NYS Bar and the Eastern District of the United States District Court.
Suzanne Caba is the Head Paralegal and supervisor of the firm's Closing Department. Ms. Caba has had many years of experience in the foreclosure and mortgage servicing areas, as well as real estate closings.
